《勞動(dong)(dong)法》第48條規(gui)定(ding)(ding),國(guo)家實行最(zui)(zui)(zui)低工(gong)資(zi)(zi)(zi)保障制度,最(zui)(zui)(zui)低工(gong)資(zi)(zi)(zi)的(de)具(ju)體標(biao)準(zhun)(zhun)由省、自治區、直轄市(shi)人民(min)政(zheng)府規(gui)定(ding)(ding)。原勞動(dong)(dong)保障部(bu)頒布《最(zui)(zui)(zui)低工(gong)資(zi)(zi)(zi)規(gui)定(ding)(ding)》,明確最(zui)(zui)(zui)低工(gong)資(zi)(zi)(zi)標(biao)準(zhun)(zhun)每兩年至少調整一(yi)次。《國(guo)務院批轉發改(gai)(gai)委等部(bu)門(men)關于(yu)深化收入分配制度改(gai)(gai)革的(de)若干(gan)意見(jian)的(de)通知》要(yao)求,根據(ju)經濟發展(zhan)、物價變(bian)動(dong)(dong)等因(yin)素,適時調整最(zui)(zui)(zui)低工(gong)資(zi)(zi)(zi)標(biao)準(zhun)(zhun)。
經福建省(sheng)政(zheng)府(fu)研究決定,從2017年7月1日起調整全省(sheng)最(zui)低(di)(di)工資(zi)(zi)標(biao)(biao)(biao)(biao)準(zhun)。調整后的月最(zui)低(di)(di)工資(zi)(zi)標(biao)(biao)(biao)(biao)準(zhun)和小(xiao)時最(zui)低(di)(di)工資(zi)(zi)標(biao)(biao)(biao)(biao)準(zhun)均分為五檔。其中,廈門市(思(si)明區(qu)(qu)(qu)、湖里區(qu)(qu)(qu)、海(hai)滄(cang)區(qu)(qu)(qu)、集(ji)美(mei)區(qu)(qu)(qu)、同安區(qu)(qu)(qu)、翔(xiang)安區(qu)(qu)(qu))月最(zui)低(di)(di)工資(zi)(zi)標(biao)(biao)(biao)(biao)準(zhun)為1700元、小(xiao)時最(zui)低(di)(di)工資(zi)(zi)標(biao)(biao)(biao)(biao)準(zhun)為18元。
月(yue)最低工(gong)(gong)資(zi)標(biao)(biao)準(zhun)適(shi)(shi)用于全(quan)(quan)日制(zhi)就業(ye)勞動者(zhe),小時最低工(gong)(gong)資(zi)標(biao)(biao)準(zhun)適(shi)(shi)用于非(fei)全(quan)(quan)日制(zhi)就業(ye)勞動者(zhe)。對從事(shi)公益性崗位工(gong)(gong)作(zuo)的(de),因調整(zheng)最低工(gong)(gong)資(zi)標(biao)(biao)準(zhun)所(suo)增(zeng)加的(de)資(zi)金可繼續從就業(ye)資(zi)金中(zhong)列支。本次調整(zheng)后的(de)最低工(gong)(gong)資(zi)標(biao)(biao)準(zhun)從2017年7月(yue)1日起執行(xing)。
最低工資標準計算方法
最低工(gong)資標準是指勞(lao)動(dong)者在(zai)法定工(gong)作(zuo)時間內或依法簽訂的(de)勞(lao)動(dong)合同(tong)約定的(de)工(gong)作(zuo)時間內提供了正(zheng)常(chang)勞(lao)動(dong)的(de)前(qian)提下,用人單位依法應當(dang)支付的(de)最低勞(lao)動(dong)報(bao)酬。其組成不(bu)包含以下項目:一是延長工(gong)作(zuo)時間工(gong)資;二是勞(lao)動(dong)者在(zai)中(zhong)班、夜班、高溫、低溫、井(jing)下、有(you)毒(du)有(you)害等(deng)特殊工(gong)作(zuo)環(huan)境、條件下的(de)津(jin)貼(tie);三是法律、法規和國家規定的(de)勞(lao)動(dong)者福利(li)待(dai)遇等(deng)。
最低(di)(di)工(gong)資(zi)(zi)(zi)標(biao)(biao)準(zhun)是(shi)按照原勞動(dong)保障部《最低(di)(di)工(gong)資(zi)(zi)(zi)規定》要(yao)求,采取(qu)比重法(即月(yue)最低(di)(di)工(gong)資(zi)(zi)(zi)標(biao)(biao)準(zhun)=最低(di)(di)人均(jun)收入戶月(yue)生活費(fei)支出水(shui)平(ping)(ping)×每(mei)一就業(ye)者的贍養(yang)系數(shu)+調整(zheng)數(shu),其中調整(zheng)數(shu)主要(yao)考慮個人繳納的養(yang)老、失業(ye)、醫療保險和住房公(gong)積(ji)金的最低(di)(di)費(fei)用)進(jin)行(xing)測算,并(bing)綜合(he)考慮GDP、在崗(gang)職工(gong)平(ping)(ping)均(jun)工(gong)資(zi)(zi)(zi)增長(chang)、居(ju)民消費(fei)價格(ge)指數(shu)和周邊省(sheng)市最低(di)(di)工(gong)資(zi)(zi)(zi)標(biao)(biao)準(zhun),以及企業(ye)承(cheng)受能(neng)力等方(fang)面(mian)的因素進(jin)行(xing)調整(zheng)修正后得出。
最低工資標準調整情況
此次(ci)調整(zheng)后,月(yue)最低工資標(biao)準(zhun)設五個(ge)檔(dang)位,分(fen)別為(wei)1700元(yuan)、1650元(yuan)、1500元(yuan)、1380元(yuan)、1280元(yuan),其(qi)中:執(zhi)(zhi)行(xing)第(di)(di)一檔(dang)有6個(ge)區(qu),執(zhi)(zhi)行(xing)第(di)(di)二檔(dang)有13個(ge)縣(xian)(xian)(市(shi)、區(qu)),執(zhi)(zhi)行(xing)第(di)(di)三檔(dang)有22個(ge)縣(xian)(xian)(市(shi)、區(qu)),執(zhi)(zhi)行(xing)第(di)(di)四檔(dang)有23個(ge)縣(xian)(xian),執(zhi)(zhi)行(xing)第(di)(di)五檔(dang)有20個(ge)縣(xian)(xian)。與調整(zheng)前相比,扣除物價影(ying)響后平均增(zeng)幅為(wei)12%,年均增(zeng)幅6%。
非全日制用工(gong)小時(shi)最低工(gong)資標準也相應設(she)五個檔,分別為(wei):18元(yuan)、17.5元(yuan)、16元(yuan)、14.6元(yuan)、13.6元(yuan),與調整前(qian)相比(bi),扣除物價(jia)影響后,平均增(zeng)幅為(wei)12.2%,年均增(zeng)幅6.1%。
