勞動合同到期了怎么辦
1、合同解除

2、合同續訂

合同到期不續簽公司要賠償嗎
勞(lao)(lao)動(dong)合(he)(he)同到期(qi)后用(yong)人(ren)單位(wei)不愿意續(xu)簽的,應(ying)當向勞(lao)(lao)動(dong)者支付(fu)經濟補償金(jin),其法(fa)律依據是:《勞(lao)(lao)動(dong)合(he)(he)同法(fa)》的第46條:除用(yong)人(ren)單位(wei)維(wei)持或者提高勞(lao)(lao)動(dong)合(he)(he)同約(yue)定(ding)條件續(xu)訂(ding)勞(lao)(lao)動(dong)合(he)(he)同,勞(lao)(lao)動(dong)者不同意續(xu)訂(ding)的情形外,依照本(ben)法(fa)第44條第1項規定(ding)終止固定(ding)期(qi)限(xian)勞(lao)(lao)動(dong)合(he)(he)同的,用(yong)人(ren)單位(wei)應(ying)當向勞(lao)(lao)動(dong)者支付(fu)經濟補償。
勞動合同到期不續簽的賠償規定
公司維持或(huo)者提高勞(lao)(lao)動(dong)合同約定條件(工(gong)資(zi)待遇等)續訂(ding)勞(lao)(lao)動(dong)合同,勞(lao)(lao)動(dong)者不同意續訂(ding),終(zhong)止勞(lao)(lao)動(dong)合同的,沒有經濟補償。
公司(si)降低勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)約定條件(工資待遇(yu)等)續訂(ding)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong),勞(lao)(lao)(lao)動(dong)(dong)者不同(tong)意續訂(ding),終止勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)的,有經(jing)濟(ji)補償。
公司和勞動(dong)者一方(fang)或者雙方(fang)不予續訂勞動(dong)合同(tong),終止(zhi)勞動(dong)合同(tong)的,有經濟補償。

勞動者月工(gong)資高(gao)于用人單位所(suo)在(zai)直轄市(shi)、設區的(de)市(shi)級人民政府公布的(de)本地區上年(nian)度職工(gong)月平均(jun)工(gong)資三(san)(san)倍的(de),向其(qi)支(zhi)付(fu)經濟補(bu)償(chang)的(de)標(biao)準按職工(gong)月平均(jun)工(gong)資三(san)(san)倍的(de)數(shu)額支(zhi)付(fu),向其(qi)支(zhi)付(fu)經濟補(bu)償(chang)的(de)年(nian)限最高(gao)不超過十二年(nian)。
本(ben)條(tiao)所稱月工(gong)資(zi)是(shi)指勞動者在勞動合同解除或者終(zhong)止前十二個(ge)月的平均(jun)工(gong)資(zi)。
勞動合同到期怎么續簽
續訂勞動合同,如原勞動合同的主要條款已有較大改變,雙方應重新協商簽訂新的勞動合同。如原勞動合同的條款變動不大,雙方可以簽訂《延續勞動合同協議書》,并明確勞動合同延續的期限及其他需重新確定的合同條款;續訂勞動合同后,用人單位應(ying)將雙方重新簽訂的勞動(dong)合(he)同(tong)或《延續(xu)勞動(dong)合(he)同(tong)協議書(shu)》(附(fu)原勞動(dong)合(he)同(tong))一式兩份(fen),送有管轄權(quan)的勞動(dong)鑒證機(ji)構(gou)進行(xing)鑒證,并到社(she)會保(bao)險(xian)經辦機(ji)構(gou)辦理社(she)會保(bao)險(xian)延續(xu)手續(xu)。
不簽勞動合同如何賠償
公司沒簽勞(lao)(lao)動(dong)(dong)合同,需要向(xiang)未簽勞(lao)(lao)動(dong)(dong)合同的(de)勞(lao)(lao)動(dong)(dong)者(zhe)支(zhi)付雙倍工資的(de)賠償(chang)(chang)。經濟補償(chang)(chang)按勞(lao)(lao)動(dong)(dong)者(zhe)在本(ben)單位工作年(nian)(nian)(nian)限每滿一年(nian)(nian)(nian)一個(ge)(ge)月(yue)(yue)(yue)的(de)工資標準支(zhi)付。六(liu)個(ge)(ge)月(yue)(yue)(yue)以上不滿一年(nian)(nian)(nian)的(de),按一年(nian)(nian)(nian)計算;六(liu)個(ge)(ge)月(yue)(yue)(yue)以下的(de),給予勞(lao)(lao)動(dong)(dong)者(zhe)半個(ge)(ge)月(yue)(yue)(yue)工資的(de)經濟補償(chang)(chang)。具體(ti)標準如下:
1、工作(zuo)年限計算(suan)標準:根據勞(lao)動(dong)者在本單位工作(zuo)年限,每滿一年支付一個(ge)(ge)月(yue)工資的標準,超過六個(ge)(ge)月(yue)不滿一年的,按(an)一年計算(suan);不足(zu)六個(ge)(ge)月(yue)的,按(an)支付半(ban)個(ge)(ge)月(yue)工資的經濟補償金(jin)計算(suan);
2、不(bu)再限定(ding)賠償期限(12年);
3、工(gong)資(zi)計(ji)算基數(shu):指勞動者在勞動合同終止前12個月(yue)的(de)(de)平(ping)均工(gong)資(zi)。這(zhe)里的(de)(de)工(gong)資(zi)是指應付(fu)給勞動者的(de)(de)工(gong)資(zi),一(yi)般包括:計(ji)時工(gong)資(zi)、計(ji)件工(gong)資(zi)、獎金、津貼和補貼、加班(ban)工(gong)資(zi)、特殊情況下支付(fu)的(de)(de)工(gong)資(zi)。
