《勞(lao)動(dong)法》第48條規(gui)(gui)(gui)定,國家(jia)實行最(zui)低(di)(di)工(gong)資保(bao)(bao)障制(zhi)度(du),最(zui)低(di)(di)工(gong)資的具(ju)體標(biao)準由(you)省、自治(zhi)區、直轄(xia)市人民政(zheng)府規(gui)(gui)(gui)定。原勞(lao)動(dong)保(bao)(bao)障部(bu)(bu)頒布《最(zui)低(di)(di)工(gong)資規(gui)(gui)(gui)定》,明確最(zui)低(di)(di)工(gong)資標(biao)準每兩年至少(shao)調整一次。《國務(wu)院(yuan)批(pi)轉發(fa)改委等部(bu)(bu)門關(guan)于深化收(shou)入分配制(zhi)度(du)改革(ge)的若(ruo)干意見的通(tong)知》要求,根(gen)據經濟(ji)發(fa)展、物價變(bian)動(dong)等因素,適時調整最(zui)低(di)(di)工(gong)資標(biao)準。
2019山東最低工資標準
根(gen)據山東(dong)省人民(min)政府(fu)《關于公(gong)布全省最低(di)工資標準的(de)通知》山東(dong)省決定從2018年6月1日起對全省各市最低(di)工資標準調(diao)整如下:
一、調(diao)整后的全省月(yue)最低(di)(di)工資(zi)標準(zhun)為1910元、1730元、1550元;小時最低(di)(di)工資(zi)標準(zhun)為19.1元、17.3元、15.5元(各市最低(di)(di)工資(zi)標準(zhun)見(jian)附(fu)圖)。
二(er)、月最低工資(zi)標(biao)準(zhun)適用于(yu)全日(ri)制(zhi)就業(ye)勞動(dong)者(zhe)(zhe);小時最低工資(zi)標(biao)準(zhun)適用于(yu)非(fei)全日(ri)制(zhi)就業(ye)勞動(dong)者(zhe)(zhe)。
三、各地要(yao)加(jia)(jia)強(qiang)對(dui)《最低工(gong)資(zi)規(gui)定》(原勞動和(he)社會保障部令第21號)和(he)最低工(gong)資(zi)標(biao)(biao)準(zhun)的宣(xuan)傳,在當地主要(yao)媒體上公(gong)布最低工(gong)資(zi)標(biao)(biao)準(zhun),讓用人單(dan)位、勞動者和(he)公(gong)眾廣為(wei)了(le)解。要(yao)進一步(bu)加(jia)(jia)強(qiang)對(dui)用人單(dan)位執行(xing)最低工(gong)資(zi)標(biao)(biao)準(zhun)情(qing)況的監督檢查,依法查處違反(fan)《最低工(gong)資(zi)規(gui)定》的行(xing)為(wei),切實(shi)維護勞動者合法權益。
另:最低工(gong)資≠標準(zhun)工(gong)資
值得(de)(de)注意的(de)(de)是,最(zui)低(di)工(gong)(gong)資(zi)(zi)標準(zhun)不包(bao)含延長(chang)工(gong)(gong)作時間工(gong)(gong)資(zi)(zi),中班、夜(ye)班、高溫(wen)(wen)、低(di)溫(wen)(wen)、井下(xia)、有(you)毒有(you)害等特殊工(gong)(gong)作環境、條件(jian)(jian)下(xia)的(de)(de)津(jin)貼,以及法(fa)律、法(fa)規和國家規定的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)福(fu)利待(dai)遇等。對勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)包(bao)吃住(zhu)屬于(yu)用(yong)(yong)人單(dan)位給予職工(gong)(gong)的(de)(de)福(fu)利,用(yong)(yong)人單(dan)位不能將(jiang)此計算(suan)在工(gong)(gong)資(zi)(zi)之(zhi)(zhi)內,更不能因此使支付的(de)(de)貨幣工(gong)(gong)資(zi)(zi)低(di)于(yu)最(zui)低(di)工(gong)(gong)資(zi)(zi)標準(zhun)。實行(xing)計件(jian)(jian)工(gong)(gong)資(zi)(zi)制(zhi)的(de)(de)用(yong)(yong)人單(dan)位必須科學合理(li)制(zhi)定勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)定額,確定基本(ben)計件(jian)(jian)單(dan)價(jia)(jia)和超額計件(jian)(jian)單(dan)價(jia)(jia),勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)提(ti)供正常(chang)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)并(bing)按基本(ben)計件(jian)(jian)單(dan)價(jia)(jia)計算(suan)的(de)(de)工(gong)(gong)資(zi)(zi),不得(de)(de)低(di)于(yu)最(zui)低(di)工(gong)(gong)資(zi)(zi)標準(zhun)。勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)個人應當繳納的(de)(de)社會(hui)保險(xian)費和住(zhu)房公積金包(bao)含在最(zui)低(di)工(gong)(gong)資(zi)(zi)標準(zhun)之(zhi)(zhi)內。
山東2018年企業工資指導線
山東省人民政府還發布了2018年企業工資指導線,其中增長上線為11%、基準線為7%、下線為3%。這是山(shan)東連(lian)(lian)續9年調整最低工(gong)資(zi)標準(zhun),連(lian)(lian)續20年發布企業(ye)工(gong)資(zi)指(zhi)導線。
企(qi)業工(gong)資指導線是企(qi)業與職(zhi)(zhi)工(gong)開展工(gong)資集體協商(shang)的重(zhong)要基礎(chu)。企(qi)業薪酬調查數據顯示,山東省企(qi)業人(ren)工(gong)成(cheng)(cheng)本在全(quan)國處(chu)于中等偏下(xia)水平,2011—2016年山東省企(qi)業人(ren)工(gong)成(cheng)(cheng)本占總成(cheng)(cheng)本比重(zhong)為12.25%,其中勞動報酬占總成(cheng)(cheng)本比重(zhong)為8.5%,社會(hui)保(bao)險費用占總成(cheng)(cheng)本比重(zhong)為1.9%,企(qi)業職(zhi)(zhi)工(gong)工(gong)資仍(reng)有一定的增長(chang)空間。
